I. Acknowledgment and Acceptance of Terms

6. **Compensation for Personal Data Violations**: GAIA TORAH is liable for damages resulting from illegal collection, processing, or use of personal data, or other violations of user rights. However, this does not apply to damages caused by natural disasters, incidents, or other force majeure events.

III. Membership Registration Obligations
To use this service, members agree to the following:
1. Provide accurate and up-to-date personal information as prompted by the service registration form. Members must not register under a third party's name. Each member is allowed to register only one account and may not create duplicate accounts.
2. Maintain and update personal information promptly to ensure its accuracy for optimal service.
3. If a member provides incorrect or false information, fails to provide required details, lacks necessary information, or registers duplicate accounts, GAIA TORAH reserves the right to suspend or terminate the account without prior notice and deny access to all or part of the service.

IV. GAIA TORAH Privacy Policy
Membership registration and other specific information are protected and governed by GAIA TORAH's "Privacy Policy.

Member Account, Password, and Security
1. After completing the registration process, members will receive a password and account. Maintaining the confidentiality and security of the password and account is the member's responsibility. Any actions performed using the password and account, once they match the registered credentials, will be presumed to have been performed by the member, regardless of whether they were personally executed. The member assumes full responsibility for all actions taken using their account and password.
2. Members agree to immediately notify GAIA TORAH if their password or account is compromised or if any security issues occur.
3. Members must log out and terminate account usage after each session.
4. Member accounts, passwords, and membership privileges are for personal use only and may not be lent, transferred, or shared with others.
5. GAIA TORAH is not liable for damages resulting from account or password theft, improper use, or any situation where GAIA TORAH cannot verify whether the actions were performed by the member, unless it can be proven that the issue arose due to GAIA TORAH's negligence.
6. If GAIA TORAH becomes aware that a member's account and password have been misused by a third party, the account will be immediately suspended, including the processing of transactions associated with that account.
7. If a member discloses their personal information, password, or payment details, thereby allowing third parties to use them, the member will bear full responsibility for the actions of those third parties.

Protection of Children and Adolescents
To ensure the safety of children and adolescents while using the internet and to protect their privacy, parents (or guardians) must fulfill the following responsibilities: Children under the age of 12 must be accompanied at all times while using the Service. For adolescents aged 12 to 20, parents should carefully consider whether to grant consent before allowing them to use the Service.
Members commit to never using the Service for any illegal purposes or in any illegal manner and agree to comply with the laws of the Republic of China (Taiwan) as well as all international internet usage practices. Members outside of Taiwan also agree to abide by the laws and regulations of their respective countries or regions. Members agree and guarantee not to use the Service to engage in actions that infringe on others' rights or violate the law, including but not limited to the following:
1. Publishing or transmitting any defamatory, insulting, threatening, offensive, obscene, vulgar, false, disruptive to public order, or unlawful text, images, or any form of files.
2. Infringing or damaging the reputation, privacy, trade secrets, trademarks, copyrights, patents, other intellectual property rights, or other rights of GAIA TORAH or others.
3. Violating confidentiality obligations imposed by law or contract.
4. Impersonating others to use the Service.
5. Transmitting or distributing computer viruses.
6. Engaging in commercial activities without prior authorization from GAIA TORAH.
7. Posting, transmitting, or sending spam, chain letters, illegal or unauthorized multi-level marketing messages, advertisements, or storing data that infringes on others' intellectual property rights or violates the law.
8. Engaging in behavior that causes discomfort, annoyance, or violates general online etiquette, thereby offending other users or third parties.
9. Any other actions inconsistent with the intended use of the Service or actions that GAIA TORAH reasonably deems inappropriate.

Modification of Service Content and Newsletters
1. Members agree that GAIA TORAH may, based on business needs and actual circumstances, add, modify, or terminate the items or content of the Service without individually notifying members.
2. Members agree that GAIA TORAH may add, modify, or terminate related activities based on actual implementation and will choose the most appropriate method to inform members.
3. Members agree to receive newsletters from GAIA TORAH two to three times a year at the email address registered in their account. If a member refuses to receive marketing messages upon notification, GAIA TORAH will cease sending further marketing communications.

Suspension and Interruption of Service
GAIA TORAH will use reasonable technology and methods to maintain the normal operation of its systems and services. However, GAIA TORAH reserves the right to suspend or interrupt the Service under the following circumstances:
1. When maintenance or construction is required for GAIA TORAH's official shopping cart communication equipment.
2. In the event of unexpected communication equipment failures.
3. When the electronic communication service used by GAIA TORAH is suspended, making it impossible to provide the Service.
4. When services cannot be provided due to force majeure events such as natural disasters or other circumstances beyond GAIA TORAH's control.

Limitation and Exclusion of Liability
1. All features provided by this Service are offered "as is" at the time of availability. GAIA TORAH is committed to maintaining the operation of the website but is not liable for errors that occur despite exercising reasonable care.
2. GAIA TORAH does not guarantee that the webpages, official shopping cart, servers, domains, or emails sent through the Service are free from computer viruses or other harmful elements. Nor does it guarantee that emails, files, or data transmissions and storage are always accurate, uninterrupted, or error-free. GAIA TORAH is not liable for damages caused by the failure, loss, or errors in the transmission or storage of such emails, files, or data.

Protection of Intellectual Property Rights
1. The software or programs used by GAIA TORAH and all content on the website, including but not limited to works, images, files, information, data, website structure, webpage layout, and design, are protected by intellectual property rights owned by GAIA TORAH or other rights holders. These rights include but are not limited to trademark rights, patent rights, copyrights, trade secrets, and proprietary technologies. No one may use, modify, reproduce, publicly broadcast, adapt, distribute, publish, publicly disclose, reverse engineer, decompile, or disassemble such content without prior written consent from GAIA TORAH or the respective rights holders. Members wishing to cite or reproduce any of the aforementioned software, programs, or website content must obtain prior written consent according to the law. Respecting intellectual property rights is a duty of all members. Any violations will hold members liable for damages to GAIA TORAH, including but not limited to legal and attorney fees.
2. Members agree not to engage in activities that infringe on others' intellectual property rights while using GAIA TORAH's services.
3. If a member is involved in infringing activities, GAIA TORAH may suspend all or part of the services and may handle the situation by notifying the member and canceling their account.
4. If you discover any instances of intellectual property infringement, please report the details of the infringement and your contact information, along with a truthful statement and declaration of ownership of legitimate intellectual property rights, to GAIA TORAH via email at: contact@gaia-torah.com

V. Member Authorization to GAIA TORAH
Members agree that any data uploaded, transmitted, entered, or provided by them may be collected, processed, stored, transmitted, and used by GAIA TORAH within a reasonable scope to provide additional information or services, compile membership statistics, conduct internet behavior research or analysis, or for any other lawful purposes. If members do not possess the legal rights to authorize others to use the provided data or to grant sub-authorization to third parties, they must refrain from uploading, transmitting, entering, or providing such data to GAIA TORAH. Once data is uploaded, transmitted, entered, or provided to GAIA TORAH, it is considered that the member unconditionally authorizes GAIA TORAH to use such data and grants GAIA TORAH the right to sub-license it to others without objection. Members also guarantee that the data provided to GAIA TORAH does not infringe on any third-party intellectual property rights. Otherwise, members shall be liable for any damages incurred by GAIA TORAH, including but not limited to litigation costs and attorney fees.

VI. Refusal or Termination of Membership Usage
Members agree that GAIA TORAH may, for the purpose of maintaining transaction security and for any reason, including but not limited to inactivity or violation of the explicit terms and spirit of this agreement, terminate the use of a member's password, account (or any part thereof), or the Service (or any part thereof). GAIA TORAH may also, after notification, remove and delete any "member content" within the Service. Furthermore, members agree that GAIA TORAH shall not be held liable to the member or any third party for the termination of access to the Service (or any part thereof).

VII. Governing Law and Jurisdiction
The interpretation and application of these Terms of Service, as well as any disputes or conflicts arising from transactions between members and GAIA TORAH in connection with these Terms, shall be governed by the laws of the Republic of China (Taiwan). The Taichung District Court in Taiwan shall be the court of first instance, except where mandatory jurisdiction is otherwise stipulated by law.
